Jacksonville White Collar Crimes

Mail fraud

In essence, mail fraud is any scheme in which money or valuables are unlawfully obtained via the postal system.  Even though many schemes are now initiated on the Internet, they are still considered to be mail fraud if the postal system is used in any part of the fraudulent transaction.

Types of mail fraud

As is true with most Jacksonville white collar crime, there are many types of mail fraud.  The most typical examples are the following:

  • Misrepresentation of mail order merchandise:  Even if the merchandise was ordered online, if it was sent through the mail system and fraudulently misrepresented to achieve the sale, a mail fraud crime may be charged.
  • Impersonation:  A typical example might be receiving a letter or email message from someone pretending to be someone else and trying to convince a victim to mail money based on a false representation.
  • Get-rich-quick schemes:  There are many forms of this type of mail fraud.  It may be as simple as purchasing materials that are supposed to walk the victim through a process to get rich, when the materials are useless.  This may also require the victim to send money to a number of individuals, such as might be required in a pyramid scheme.

Anywhere in the United States, including Jacksonville, white collar crime law pertaining to mail fraud is governed by U.S. Federal law, and prosecution can be intense.  But, it is not uncommon for an individual or business to be charged with mail fraud when no crime has actually been committed.

A good example would be when a company ships many boxes of mail order merchandise in good faith, but the merchandise is damaged as a result of faulty shipping containers.  This could actually be a case of liability on the part of the container manufacturer, rather than the business charged with mail fraud.  This is why it is so important to retain an experienced Jacksonville white collar criminal lawyer who knows how to investigate the charges the moment you suspect that you may be under investigation for, or charged with, mail fraud.
