Child Pornography

In 2004, a Child Exploitation and Obscenity Section task force was created under the U.S. Department of Justice, with the goal of prosecuting pornography on the Internet, cable television and at adult bookstores.  In addition to arrest and prosecution,  obscene material may be confiscated, along with profits and proceeds.

Child pornography charges are felonies carrying heavy sentences under federal laws. Maximum and mandatory minimum sentences range greatly depending on the activity involved, such as whether the charge is for possession, engaging in sexual activity, or advertising to procure minors for illicit sexual activity, or distribution of child pornography.  Depending on the type of offense, repeated violations could result in life in prison.

Multi-Agency Investigations

For a number of years, multi-agency, multi-jurisdictional Task Forces, combining the resources of federal, state and local law enforcement, have conducted ongoing investigations through undercover operations into the distribution of child pornography.

Florida, along with the federal government, has enacted various laws regarding computer pornography involving minors.  People don’t realize that sending email attachments containing child pornography is a federal crime, or that receiving child pornography on your computer (whether or not you have deleted it) may be regarded as a crime, or that even owning a hard drive that someone else previously owned that contains deleted child pornography files could be used as evidence against you.
